What you will do

Associate Litigation and Employment Counsel will serve as primary attorney in the LatAm region for all Litigation and Employment matters and claims. The role will provide in-house defense of product liability, commercial and employment claims, and lawsuits. The role also will serve as primary employment legal contact for LatAm region HR representatives to support strategy on a broad range of complex employment law matters.

Essential Duties & Responsibilities:

Litigation

  • Engaging in all aspects of pre-litigation claims and lawsuits, including intake, claim analysis, communication with legal and business colleagues and clients, development and implementation of strategy, management of outside counsel, negotiations, and finalization and closure of matters.      
  • Providing results driven legal advice in a fast-moving business environment while coordinating and collaborating with other in-house counsel.
  • Providing timely advice and counsel to business clients regarding significant litigation and other matters that mitigate risk.  
  • Communicating (verbal and written) with all areas of the organization including Company leadership and other functions (regulatory, finance, human resources, operations, supply chain, manufacturing, R&D, sales, and marketing, among others), and divisions.
  • Collaborating and communicating with colleagues, management, and outside counsel, as well as external groups including patients, opposing counsel, customers, and health care professionals.
  • Supporting Global Litigation & Employment Team in implementing strong defense to product liability matters, as well as the broad range of complex issues and challenges associated with defending a large company.
  • Working both independently as well as part of a team overseeing and executing on multiple projects and assigned cases and claims simultaneously.
  • Providing strong organizational and coordination skills to numerous projects and conflicting demands in a fast-paced environment.

Employment

  • Partner with Regional/Country and/or Divisional/Business Unit HR, business, and functional leaders within LatAm region to set strategy regarding time-sensitive and complex labor and employment issues with divisional/BU and/or regional impact.
  • Provide timely and strategic advice to business stakeholders and COE partners based upon deep understanding of business priorities and goals within the region and/or country, in accordance with enterprise-wide strategy.
  • Direct responses to employment claims (e.g., employment discrimination, pay practices, wrongful termination) and negotiate settlement of medium to complex claims.
  • Advise on and/or assist with internal investigations regarding suspected violations of Stryker policy and/or law.
  • Advise on medium to complex reorganizations and restructurings with business unit, divisional, country or regional impact.
  • Develop and/or advise on HR policies and procedures within the region, in consultation with HR Workplace Practices team.
  • Advise on and conduct trainings regarding labor and employment practices and developments in employment laws throughout region. Advise on employment-related merger and acquisition due diligence, deal negotiation and integration activities impacting the region.
  • Draft, edit and negotiate employment-related contracts. Follow and educate others on internal processes to drive enterprise-wide consistency and best practices. Collaborate and communicate with colleagues, management, and outside counsel.

What you need

  • Law degree and admission to practice law is required.
  • Professional proficiency in Portuguese, Spanish and English languages.
  • Relevant legal experience gained by working in an in-house setting, a law firm, or both. Litigation experience relating to product liability defense, medical device, pharmaceutical, and life sciences strongly preferred.
  • Demonstrates ability to work effectively with colleagues in a global organization, with ability to quickly gain trust and confidence of colleagues, stakeholders, and management.
  • Ability to work well independently and in a team.
  • Possesses excellent judgment and analytical skills.
  • Experience providing timely and strategic legal advice.
  • Possesses communication skills and ability to convey complex legal principles clearly and concisely.

Travel Percentage: 30%
